Terms of Service
These Terms of Service govern your access to and use of MLS Guardian websites, applications, subscriptions, alerts, and related services.
Agreement to Terms
By creating an account, purchasing a subscription, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Service.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You agree to provide accurate account, contact, billing, and property information and to keep that information current.
Authorized Property Monitoring
You may only submit properties that you own, control, manage, or are otherwise authorized to monitor.
You are responsible for verifying that your use of the Service complies with all laws, contracts, rules, and obligations that apply to you and the properties you monitor.
MLS Guardian provides monitoring and alerting tools. We do not remove listings, contact agents on your behalf, provide legal advice, or guarantee that a listing is fraudulent or authorized.
Subscriptions, Billing, and Cancellation
Paid plans are billed through our payment processor, Stripe. By purchasing a subscription, you authorize recurring charges for the selected plan until canceled.
Plan limits, features, and prices are shown at checkout or in the Service and may change prospectively with notice where required.
You can manage or cancel your subscription through the account billing portal. Cancellation stops future renewal charges but does not automatically entitle you to a refund unless required by law or expressly stated by us.
Alerts and Listing Data
Alerts may be delayed, incomplete, inaccurate, or unavailable due to third-party data availability, technical issues, address-matching limitations, carrier delivery failures, or other factors.
Listing data and agent contact details may come from third-party sources and are provided for informational purposes only.
You are responsible for independently verifying any alert before taking action.
Acceptable Use
You may not use the Service to violate law, infringe rights, monitor properties without authorization, harass others, scrape or reverse engineer the Service, interfere with security, or attempt unauthorized access.
You may not upload or submit malicious, false, misleading, or unlawful information.
We may suspend or terminate access if we believe your use creates risk, violates these Terms, or may harm MLS Guardian, users, service providers, or others.
Third-Party Services
The Service may rely on third-party providers for authentication, hosting, databases, payments, SMS, email, address validation, property data, listing data, monitoring, and analytics.
Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services that we do not control.
Intellectual Property
MLS Guardian and its software, design, trademarks, content, and technology are owned by us or our licensors and are protected by intellectual property laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for your personal or internal business property-monitoring purposes.
User Content and Feedback
You retain rights in property information and other content you submit, but you grant us the rights needed to host, process, display, validate, monitor, and use that content to provide and improve the Service.
If you provide feedback or suggestions, you allow us to use them without restriction or compensation.
Disclaimers
The Service is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that alerts will detect every unauthorized listing.
Limitation of Liability
To the maximum extent permitted by law, MLS Guardian will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities.
To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid to MLS Guardian for the Service in the three months before the event giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless MLS Guardian from claims, losses, liabilities, damages, costs, and expenses arising from your use of the Service, your submitted information, your monitored properties, or your violation of these Terms or applicable law.
Changes to the Service or Terms
We may modify the Service or these Terms from time to time. Updated Terms will be posted on this page with a new last updated date. Continued use after changes become effective means you accept the updated Terms.
Governing Law
These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law rules, unless another law applies and cannot be waived.
